A discussion around contracting for live and rescheduled events, covering force majeure clauses, common law defences to breach of contract due to impossibility, and IP and copyright issues pertaining to online/virtual performances and pre-recorded performances. With all of that in mind, we will look at smart contracting, necessary protections and imperative contingencies in this “new normal”.

Paul Banwatt is an IP, entertainment and technology lawyer working at Gilbert’s LLP in Toronto. As a music lawyer, Paul represents major label household names and independent artists beginning their careers. Paul is a member of the Toronto Music Advisory Committee (TMAC) and a board member of the Long Winter Music and Arts Festival.

Paul has also had a successful career as a musician. Paul's band, The Rural Alberta Advantage, has received two Juno nominations, a CBC Music Award, the Galaxie Rising Star Award, played the Coachella Music Festival, and continues to appear on Billboard sales and radio charts. Paul's music has been featured in numerous publications including Spin, NME, Playboy Magazine, and The New York Times.
